First move is to take pictures of everything. Then call the local code enforcement and get an inspection rolling asap. Check out the “Massachusetts State Sanitary Code” 105 CMR 410.000 to see what other Sanitary Code violations your landlord may be engaged in at your expense. You can also file for an injunction in Housing Court forcing the landlord to take action within a reasonable period of time. The law has long looked at a litigant who “sleeps on their rights” to have waved them so – don’t sleep on your rights then try to complain later it was a big deal. If it is a special circumstance like lead paint poisoning or infestation, take your afflicted family member(s) for comprehensive medical evaluation to rule out or commemorate any personal injuries suffered asa result of the landlord’s negligent maintenance.
